I have read many bills in last year and a half. There are a bunch of such bills pending..The problem is that they just stay pending...Unless that gets placed on the senate calender introducing the bill is useless...

Both and spouse and I received my receipts for our I-485, I-140, EAD, AP 09/19/07. On 09/24/07 we received fingerprint notice and on 09/27/07 we received our EAD card. I am quite surprise by how fast it came. Here are my details :
Priority Date: 10/15/04
Type: EB3
I-140/I-485: Concurrently filing at NSC. Receipt date 07/07/07
Checks cashed: 09/10/07
Receipts received: 09/19/07
Fingerprint appt: 10/09/07

Do not fight we are EB2/EB3/EB1. This is law and instructed by politicians. Divide and rule.
Same thing they did and now and you see the result in IV forum where people fight that create below category
1.Based on educations (US masters/US bachlors/Non US masters/Non US bachleors etc etc)
2. Based on experience - US experioence non us experience
3. EB1/EB/2 EB3
4. L1/H1/b1/b2
5. Family based
6 etc etc
If you count the division you can say based on heights, color, marries and non marries status etc.
So stop fighting based on politicians category and help IV to goahead and fight for all.

I came on extension. I think they are more critical about the companies with whom you are working for. All my friends with extended their visa with no problems. I it is very hard to conclude on this. But scares every one if we keep saying they can not extend their visa.
Be prepared with good documentation and you should be fine.
I don't work with L-1 companies.
I know of this because many of them have h-1b's and want to know how to switch.

IO:--> Dear applicant, You can apply for a long process to getting your PR/GC and here are the deals. Apply with high fees. Get RFE answered within limited time frame or loose. Wait for labor (go through labor pain..:-) ), do not get/expect promotion, Oh ya get your well educated spouse, Make them sit at home, make them feel unproductive, pay all your taxes, pay your social security BUT do not expect anything back, In the process if your kids age out separate them from you (send them back), If you wish to study pay highest fees, if you get promoted stand in queue again, pay frequent medical fees, AP, EAD fees, and yes YOU can always TRACK RNs for them. You can whine, post your opinions, when we change policies on the fly and create more hardships even if you have stayed here for more than 6 years, you can call up our customer service, be imaginative and get to level 2 and still get yelled at, asked to wait for 90 days (std reply), etc, but you can always go to good forum like IV and instead of working on your cause, create confusion, DEMAND action, not contribute....etc.
H1B applicant:--> SO WHAT IS THE CATCH.
IO:--> YOU THA MAN. Welcome to USA. Land of the free home of the brave. But for you there will be no freedom and for your type..stay in fear.

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

PD should be established on the first labor application.
I feel this is more practical than number of years in US.

Under the latest interpretation, EB3-I India will not get benefit until EB3-ROW gets benefit. So EB3-ROW benefiting will eventually benefit Eb3-I. That is the logical background.
The other two issues , which provided temporary relief, would have been redundant If we had recaptured the visas. Most of us, across the EB category/Country, would have been current or near current , rendering these issues redundant.
IV still went ahead with it (I am glad) knowing fully well recapture is difficult issue.
So no harm in EB3-I seeking temporary relief while still joining forces on the recapture issue.
Now you need to explain How EB3-I seeking favorable interpretation of spill over distribution undermines "Recapture effort". How are these related??

I have a unique position. couple of weeks back I was told that have fatal cancer and won't live pass 4-6 months. After recovering from initial shock I am wondering if my wife will be able to continue her american dream or she will have to head home after me.
I have filed 485 with approved 140 back in june, 2007 with PD of March, 2003
Please help.

I personally know couple of people who were scared by the doctors about having a serious health condition but they totally recovered and are fine now. The doctors here just alert you about the worst that could happen to save themselves from being sued. So please don't lose hope and try other methods.
I am sure USCIS will consider your situation and your wife will get her GC without any problems. You just have to go in the right route. Contacting an attorney would be the way to go.

Well, you assume family members can get AP and EAD after submitting I-485. Not true for many people. Take myself as an example, I was not lucky enough to file my I485 in 2007. So with a PD of early 2007, I have none of the benefit from AOS a(B) who is the beneficiary (including a spouse or child of the principal alien, if eligible to receive a visa under section 203(d) ) of--
(i) a petition for classification under section 204 that was filed with the Attorney General on or before 2a/ April 30, 2001; or
(ii) an application for a labor certification under section 212(a)(5)(A) that was filed pursuant to the regulations of the Secretary of Labor on or before such date; and 2a/
t all.
Although for me it's not a big deal because my wife will soon get her PhD and will file for her own immigration petition. This actually works better for us, because it will make the line much shorter and both of us will get the green card much quicker.
However, for those who do not work and solely depend on their spouses to get green card. This change can spell disaster for them during the long wait caused by retrogression without the ability to file AOS.

Instead of working on recapture..we must work on filing for 485 even if PD's are not current.. this way.. atleast in this recession ppl can be assured of some piece of mind.
visa recapturing will not happen..am not being pessimistic..its just too much of a hassle...needs a law and all that.. too complicated.

In my own terms, there is only one line defined by the priority date. So you can amuse yourself all you want. Its not gonna change the law.

Guys, any update on your FP notices? I have written to ombudsman almost 3 weeks ago about not receiving FP notices and nothing yet...

EADplease,
I called them and reached an IO officer and told her that I see my checks are cashed and there is a receipt number behind the check but its illegible and can she confirm the numbers for me. She asked for DOB, address, full name etc. and then gave me the receipt numbers for EAD, AP and AOS.
But if your checks are cashed then the receipt notice must be in the mail.:)
